Motion : ASSISTED SUICIDE SHOULD BE LEGAL

The debate goes to the opposition but there were major flaws on both sides. The most interesting point made throughout was by op, who briefly raised the question of whether death, in and of itself, has a moral value at all. More should have been made of this (read M. Tooley). Secondly the constant confusion between euthanasia - which involves a decision by a third party - and voluntary suicide, only involving two parties, was unhelpful.

Once the debate had been established on moral grounds - the end of suffering, a utilitarian right, etc. - Gov needs to give a coherent case that extends further than 'cancer is nasty', they failed to do so. The lack of evidence on both sides was disturbing as there are no shortage of examples on this subject. In a format such as this there is no excuse for poor research and simply throwing the name of Mill around does not change that fact. For example there is evidence from Holland that doctors who assist suicide suffer severe trauma - where was that? There are legal analyses of sustaining life being a cruel and unusual punishment - where was that?

In terms of manner, stop thinking about the debate as a vacuum. Constantly bickering over points that anyone with half a brain can see have been shot down already achieves nothing. Develop a thesis - or counter thesis - acquire the available facts, spot the flaws in your opponent's concept and use substance, strategy and style to refute them. This is not an exercise in banging the same drum but rather one in interacting with ideas. Stop talking about the discussion and deal with those ideas.

If I am honest, I would give this debate to neither of the teams but, since this is not an option, opposition wins. Opp had marginally more use of logic and slightly less assertion. Both teams need to understand that simply asserting that something is 'bad' or 'wrong' is not enough. You also need to focus on the motion - or definition - at hand. Be clear about the setting of the argument and avoid unsubstantiated generalisation.

This debate had two aspects: pragmatics and philosophy.

On pragmatics, the debate was virtually a wash. Whether or not patients can be rational (and whether their rational wishes will ultimately be fulfilled by doctors) seemed to be muddled by the Opposition, which included the contention that doctors might be abusive and/or incompetent to gauge rationality of their patients. Obviously no debater should be precluded from making such arguments, but more evidence would be helpful to persuade a judge that this is the case. Opposition's societal attitude argument, while perhaps low-impact in the immediate-term, was interesting.

However, the Opposition adequately addressed the main utilitarian argument in favour of assisted suicide, namely chronic pain. I appreciated the erosion of this argument to a very limited number cases, suggesting that patients might "throw in the towel" when it is ultimately unnecessary/undesirable to do so.

On philosophy, I believe opposition carried the day. While not without flaws, they were much more fully engaged in this aspect of the debate. For example, they raise the suggestion that any debate involving utility maximization presupposes being alive in the first place. This argument was not adequately addressed by the government team.

On balance, the win goes to opposition.

This was a difficult debate to adjudicate. I ultimately had difficulty with the positive matter of both sides; it seems that both sides' strengths lied with refutation. Both teams would also be wise to exercise their judgment in deciding which arguments are important and which are unimportant. Many points of contention in this debate - i.e. the discussion of hard drugs versus tobacco - were belaboured and tangential.

반대 팀이 이겼지만 양 팀 모두 주요한 결점이 있었다. 가장 흥미로웠던 주장이 반대 팀에게서 나왔고, 그 팀은 죽음 자체가 도덕적 가치를 가지는지 아닌지에 대해 질문을 제기했다. 이 부분을 좀 더 만들어 나가야만 했다.(M. Tooley를 읽어보라). 두 번째로 제3자가 결정에 관련된 안락사와 오직 양자가 관련된 자발적 자살에 대한 상시적인 혼돈은 도움이 되지 않았다.

토론이 고통을 끝내는 것이나 공리주의적 권리, 그리고 기타 등등과 같은 도덕적 기반 위에 형성된 이상, 찬성 팀은 ‘암은 역겨운 것이다’에서 더 확장해서 일관된 주장을 폈어야 했는데 그러지 못했다. 양 팀 모두에게 증거가 없었다는 점은 이 주제에 대해 사례가 부족함이 없는 것만큼이나 방해였다. 이런 토론 방식에서 자료 조사가 빈약했다는 점은 변명할 여지가 없고 밀의 이름을 단순히 던져 놓는 것이 그 사실을 바꿔 놓지도 않는다. 예를 들어 홀란드에서 자살을 도운 의사들이 심각한 정신적 충격을 겪고 있다는 증거가 있다고 하는데 그게 어디서 나온 증거인가? 생명을 유지하는 것이 잔인하고 일반적이지 않은 처벌이라는 법학적 분석이 있는데 그건 또 어디서 나온 증거인가?

전달 방식에 대한 얘기를 하자면, 토론이 진공 상태와도 같은 것이란 생각을 멈춰라. 누구나 대충 머리를 쓰면 나오는 주장들을 놓고 계속 언쟁을 하다가는 쉽게 깨질 수도 있고 이미 얻을 건 아무것도 없게 된다. 명제나 대응 명제를 발전시켜야 하고 이 때 가능한 사실들을 취하고 상대 팀의 관념에서 약점을 밝혀내고, 내용과 전략 그리고 전달 방식을 활용해서 그 부분을 반박하라. 이것은 같은 드럼을 계속 치는 식의 연습이 아니라 아이디어를 교환하는 과정이다. 그 논의를 그만하고 아이디어들을 다뤄라.

솔직히 말하자면, 난 어느 팀도 고르고 싶지 않지만 그럴 수 없기 때문에 반대 팀의 손을 들어줬다. 반대 팀이 근소한 차이로 논리를 좀 더 활용했고 뒷받침 없는 단언을 덜 꺼냈다. 양 팀 모두 무엇인가가 ‘나쁘다’ 또는 ‘잘못됐다’ 고만 단순히 언급하는 것은 충분하지 않다는 점을 이해할 필요가 있다. 여러분은 또한 토론 주제나 정의에 최우선적으로 집중할 필요가 있다. 주장을 설정하는 데 분명히 하고 잘 구성되지 않은 일반화를 피하라.

심판 판정 : kotrly

이번 토론은 두 가지 측면을 보여줬다. 실용적 측면과 철학적인 부분이다.

실용적 측면에 있어서, 이번 토론은 사실상 빛이 바랬다. 환자들이 이성적일 수 있는지 없는지의 문제는(그리고 그들의 이성적인 소망을 의사들이 충족해 줄 수 있는지는) 반대 팀에 의해서 뒤죽박죽이 되어 버렸고, 그 때 반대 팀은 의사들이 부패할 수 있다든가 그리고/또는 그들이 담당하는 환자들이 이성적으로 판단할 수 있는지를 진단할 능력이 안 될 거라는 주장을 꺼냈다. 확실히 이런 주장을 하지 않을 토론자는 없겠지만 이것이 바로 진실이라고 심판을 설득하는데 도움이 될 만한 증거를 더 제시하라. 반대 팀이 사회적 태도에 대한 주장을 꺼냈는데, 비록 당장은 별 영향력이 없었지만 흥미로웠다.

하지만, 반대 팀은 자살을 돕는 행위를 지지하는 주된 공리주의적 주장, 다시 말해 만성적인 고통에 대해 적절하게 대처했다. 나는 이 주장이 굉장히 제한된 몇몇 사례로 국한된 점을 높게 샀고, 환자들이 ‘포기하는 것’이 궁극적으로는 불필요하거나 바람직하지 않은 행위라는 점도 제시되었다.

철학적 측면에서, 나는 반대 팀이 날을 잡은 것처럼 보였다. 특별한 결점 없이, 반대 팀은 토론의 이 측면을 보다 잘 파고들었다. 예를 들어, 반대 팀은 공리의 극대화와 관련된 그 어떤 토론도 생존을 전제로 한다는 점을 처음부터 제안했다. 찬성 팀은 이 주장에 대해 제대로 대처하지 않았다.

비교해 본 결과, 반대 팀이 이겼다.

이번 토론은 판정하기 어려웠다. 이는 양 팀 모두의 긍정적인 내용물들 때문에 생긴 어려움이었다. 양 팀의 강점은 반박에서 나왔다. 양 팀은 또한 어떤 주장이 중요하고 어떤 주장이 중요하지 않은지 판단하는 연습을 하는 게 현명할 것이다. 이번 토론의 내용을 구성했던 많은 주장들, 이를테면 마약과 담배를 대비하는 논의는 상세하게 얘기되었고 옆길로 샜다.
