Motion : SEXUAL ORIENTATION SHOULD BE CONSIDERED GROUNDS FOR ASYLUM.

Defending: Mongolia, Opposing: Ghana

Decision by Adjudicator: Rose Helens-Hart

Congratulations to both teams for advancing to the second round. I cast my ballot for the Proposition from Mongolia. After reading each team's arguments, I conclude that GLBTs are discriminated against in some countries and when said countries refuse to protect GLBTs’ human rights and create laws that admonish their very beings that those individuals should have to right to seek asylum. Three questions guided my decision:

1. Are GLBT’s a persecuted social group?

There is little question in my mind as to whether or not GLBTs are discriminated against and or persecuted. Common knowledge and the Prop’s evidence paints a clear picture that they are. Opposition offers counter evidence that says GLBTs are doing just fine (note that this evidence comes from the US…which has antidiscrimination laws that are intended to protect GLBTs and other minorities) but refuses to explain why their evidence should be held supreme since it seems counter intuative. They then contradict themselves by asserting that most of the world abhors homosexual behaviors.

Prop does not define social group well?only asserts that there are many GLBTs and they have formed organizations. I then assume that their definition of a social group is a group of people that has organized around a common factor. This does not seem inconsistent of Opp's definition of "social group". Opp claims that GLBTs are not a group but a "class" but does not say what the definition of a class is. Seems like a social class would be just as significant as social group and the Prop does not need to prove they are a social group but just that they too should be granted asylum so the definitional attack did not hold.

Throughout the debate, Opp uses US population statistics from the 1980’s (even one from 1979!). The Prop and Opp should have examined the evidence more carefully as these dates severely hurt the credibility of the Opp. The beginning of the 80s in US saw the start to the gay rights movement so I’m sure the number or identifying GLBTs has risen as law and society has become more liberal. The “poor evidence” does not effect my decision as the Prop does not attack it on those grounds and is able to over come it without bringing up published dates but the Opp should be aware that outdated evidence is not solid support.

2. Would asylum benefit GLBTs?

Seems like a straightforward answer. Yes. Prop could have used more solid evidence of non-discrimination laws from countries where seekers could go to prove asylum would provide a better life…but Opp kind of does that for them by giving stats about how great GLBTs are doing in the US?they are wealthy because they can't have children(ouch…) and they are college educated. I agree with Opp when they say that safety cannot be 100% guaranteed but it is reasonable logic to claim that (as Prop does) that GLBTs would be better protected in a country that actually attempts to protect them rather than making the way they were born a crime against the state.

Prop has two great “slams” on Opp evidence under this particular area. In Opp point 2, they discover another statistical problem when Opp claims 98% of the world population opposes GLBTs yet 3.5% are supposed to be “homosexual” themselves. Either Opp is claiming gays hate themselves or they were not paying close attention to their evidence and the credibility of their evidence. The other slam comes when Prop points out that the UK discretion test was overturned and questions the credibility of blog posters. Opp should be warned again that blogs often provide biased, lay commentary and are not sources of credible evidence. Wikipedia is also a questionable source as it can be altered by lay and biased persons.

3. How would asylum for this group effect culture?

So, Opp may be wondering how they could have won this debate without sounding cruel and bigoted. I think a couple of times they started to sniff out the right trail but got sucked into the easy, yet offensive arguments such as “Considering this sexual orientation for asylum will only put innocent individuals such as children, women and teenagers at risk base on the well known life style of homosexuals…” Sounds like Opp is really suggesting that HIV infected GLBTs would molest and rape children, women and teenagers because that is just a part of their “well known life style”…Anyways, Opp starts to make a couple of interesting arguments about culture.

1. Could start a culture war among counties.:

This argument needed to be developed more. How would telling a country that they do not treat their GLBTs well be anymore of an act of war than telling them that they do not treat their political dissidents or ethnic minorities well?

2. GLBTs need to work for social equality in their home countries.:

This could have been the start to a counter solution for Opposition. Is there a way for GLBTs to be at least minimally protected why they work toward social and political understanding? Or is this work more imporatant than safety? It seems reasonable to ask, “if all the GLBT move away, how will social mindset change?” Asylum argues for the separation of groups, which may impede the development of tolerance and understanding of GLBT. The argument had potential but the Opp does not describe how GLBT individuals could work toward equality when they are discriminated against. Absent this, even though I am inclined to believe it will slow social progress, I had to prefer the case that ensures at least a minimal increase in safety of GLBTs. There needed to be a stronger case for culture being more important than people’s safety. A discussion of value hierarchies would have been useful for both teams.

Other notes: While Prop constructive argument was adequate I felt is was not particularly creative. Most of Prop’s constructive time was spent on proving that GLBTs are persecuted?a pretty easy claim to prove. Prop’s rebuttal to Opp claims, however, was excellent. They paid attention to the details of the evidence and questioned logic well. Opp took a difficult route describing GLBTs as diseased criminals who are treated as equals while 98% of the world population hates them. Concessions can be powerful. Opp could have agreed that discrimination happens but that asylum is not the way to solve or avoid it.

Decision by Adjudicator: maledictus

My vote goes to the Proposition side of this debate - they set up a good case proving that sexual orientation is a factor that endangers the livelihood of people in the same way that other factors that are currently considered as valid grounds for seeking asylum in the status quo. The Opposition failed to prove their claims in their rebuttal that providing these individuals with asylum would not impact on their safety, as Proposition sufficiently illustrated the specific harms they face in their home countries due to their legislation and social structure. On the other hand, the Opposition case tried to prove harms to the host countries alleging that the LGBT community has heightened sexual and criminal activity, however the Proposition did adequately respond to those points by showing that the LGBT community is not as large of a threat to society as Opposition alleged, especially in cases of criminality. Opposition also tried to prove that in any case, LGBTs would not be able to find better conditions anywhere, mainly because of the way society views them, however their claims were, as in the case of the criminal activity point, perhaps over-exaggerated and Proposition did sufficiently prove that there are countries and areas in the world where the legislation and the mentality of the people would guarantee the asylum seeker's safety and livelihood. Finally, the issue of recent practices in asylum seeking were dealt with effectively by the Proposition's evidence that the practice of the discretion test has been abandoned already and that the commentary used by the Opposition to prove the point wasn't necessarily targeted at the LGBT community but at the practice of asylum seeking in general.

1. 성적 소수자들이 박해받는 사회 집단인가?

성적 소수자들이 차별을 받는가, 또는 박해를 받는가의 여부는 별로 궁금하지 않았다. 상식적으로도 그렇고, 찬성 팀의 증거를 통해 그들이 박해받는다는 점은 분명히 드러났다. 반대 팀은 반대 증거를 제시해서 성적 소수자들이 잘 지내고 있다고 이야기하고자 했으나(여기서 짚고 넘어갈 점은 이 증거가 미국을 가리키고 있다는 점이다. 미국에는 성적 소수자들과 다른 소수자들을 보호하기 위한 차별 금지법이 있다) 그 증거가 직관에 어긋나는 상황에서 왜 그것을 최고의 증거로 받아들여야 하는지는 설명하지 않았다. 그들은 세계의 대다수 지역에서 동성애 행위가 혐오 대상이 되고 있다는 이야기를 꺼내면서 자기모순에 빠졌다.

토론을 전반적으로 살펴보자면, 반대 팀은 1980년대 미국의 인구에 대한 통계들을 사용했다(심지어 1979년도 통계도 있었다!). 이렇게 오래된 통계가 반대 팀 주장을 신뢰할 수 없게 만든다는 점을 고려한다면 양 팀은 그 증거를 보다 조심스럽게 검토했어야 했다. 80년대 초반에 미국에서 동성애자의 권리 신장을 위한 사회 운동이 시작되었고 성적 소수자들이 목소리를 내기 시작했으며 법과 사회가 보다 성적 자유를 허용하는 쪽으로 변해 갔다. 이런 "빈약한 증거" 때문에 내 결정이 바뀌지는 않았다. 찬성 팀은 그 증거들의 효력을 캐묻지 않았고 그 증거가 언제 만들어졌는지를 굳이 언급하지 않고도 우위에 설 수 있었지만, 반대 팀은 철 지난 증거로는 주장을 제대로 뒷받침 할 수 없다는 점을 명심해야 한다.

2. 성적 소수자들에게 망명이란 선택지가 도움이 될 수 있는가?

그렇다고 쉽게 답할 수 있을 것 같다. 찬성 팀은 차별 금지법에 대한 보다 확실한 증거를 들면서 성적 소수자들이 망명을 가서 더 나은 삶을 찾을 수 있는 곳이 있다는 주장을 펼 수 있었는데 그러지 못했다. 그런데 성적 소수자가 미국에서 얼마나 잘 살고 있는지에 대한 통계를 제시함으로써 반대 팀이 찬성 팀을 도와준 꼴이 되어 버렸다. 성적 소수자들이 아이를 가질 수 없기 때문에 부유하다는 것과(이런...) 그들이 대학 교육을 받았다는 내용도 있었다. 반대 팀 말대로 그들이 안전을 100% 보장받을 수는 없겠으나 찬성 팀이 주장한 대로 국가가 해당 행위를 범죄로 규정한 곳보다는 국가가 그들을 보호해 주고자 하는 곳에서 성적 소수자들이 보다 나은 보호를 받을 수 있다는 점은 합리적으로 추론할 수 있다.

아래에 제시할 부분에서 찬성 팀은 반대 팀의 증거에 대해 두 가지 큰 "승리"를 거두었다. 반대 팀의 두 번째 주장에서, 세계 총 인구의 98%가 성적 소수자에 대해 반대 의사를 표한다는 이야기가 제시되었는데 똑같은 모집단에서 3.5%는 "성적 소수자"들이라는 점도 언급되면서, 찬성 팀은 통계상의 또 다른 문제점을 찾아냈다. 반대 팀은 성적 소수자들이 스스로를 혐오한다는 이야기를 하려고 했거나, 그들의 증거에 대해 주의를 제대로 기울이지 않아 그 신뢰성을 깎아먹었다. 찬성 팀은 영국의 재량권 시험 결과가 뒤집혔다는 점을 지적하고 블로그에 게재된 포스터의 신뢰성에 의문을 표하면서 또 다른 대승을 거두었다. 블로그는 종종 편향되고 비전문적인 이야기를 늘어놓고 신뢰할 만한 증거가 되지 못한다는 점에서 반대 팀에 다시 한 번 경고를 해야겠다. 위키 백과도 비전문가들과 특정한 견해에 편향된 이들이 쉽게 편집할 수 있다는 점에서 그다지 신뢰할 만한 정보원이 아니다.

3. 이들 집단에 망명을 허용하는 것이 문화에 어떤 영향을 끼치는가?

이쯤 되면 반대 팀은 어떻게 잔인하고 편협한 이야기를 꺼내지 않고도 이번 토론을 이길 수 있을지 궁금해 할 것이다. 반대 팀은 올바른 길을 수차례 찾아내기는 했으나, “성적 성향을 망명의 근거로 고려하게 되면 어린이나 여자, 10대처럼 선의의 개인들이 동성애라고 하는 위험한 생활 습관에 노출되게 된다.”와 같은 공격적인 주장을 쉽게 꺼내놓는 함정에 빠졌다. 반대 팀은 인간 면역 결핍 바이러스에 감염된 성적 소수자들이 어린이나 여성, 10대들을 성추행하고 강간하는 것을 그들의 “잘 알려진 생활 습관”이라고 정말로 주장하려는 것처럼 보였다. 어쨌든, 반대 팀은 문화와 관련해서 몇 가지 흥미로운 주장을 제시했다.

1. 국가 간에 문화 전쟁이 벌어질 수도 있다. :

이 주장은 보다 심화될 필요가 있었다. 단순히 정치적으로 반체제 성향을 보이는 이들과 소수 민족들을 존중하지 않는 것과는 다르게 국가가 성적 소수자들을 제대로 존중하지 않는 것을 어떤 연유로 전쟁이라 볼 수 있는가?

기타 사항 : 찬성 팀의 주장이 적절하기는 했지만 딱히 창의적이지는 않았다. 찬성 팀 주장은 많은 부분이 성적 소수자들이 박해받는다는 것을 입증하는 내용이었다. 이건 그냥 증명을 쉽게 하려고 꺼낸 주장이다. 하지만 반대 팀의 주장에 대한 찬성 팀의 반박은 훌륭했다. 그들은 증거의 세부 내용에 주의를 기울이고 논리에 의문을 던지는 데 강점을 보였다. 반대 팀은 전 세계 인류의 98%가 성적 소수자들을 혐오하고 있는데 그들이 평등한 대우를 받고 있다는 주장을 하고, 또 성적 소수자들을 병든 범죄자처럼 묘사하는 어려운 길을 택했다. 전략적 양보도 때론 강력하다. 반대 팀은 차별이 존재한다는 점에 동의하면서도 망명이 그 문제를 해결하거나 피하는 방법이 아니라는 점을 보일 수 있다.

이번 토론에서 찬성 팀에게 투표했다. 완곡적 성적지향으로 인해 그들의 삶이 위협을 받는다는 점을 잘 증명하면서 현재 망명을 허용하는 여러 가지 조건과 성적 소수자들의 상황이 어떻게 서로 부합할 수 있는지를 보여줬다. 이들 개개인이 망명을 했을 때 별로 더 안전해질 것도 없다는 그들의 반박은 그들의 주장을 입증해주지 못했다. 찬성 팀이 충분히 설명한대로 그들의 본국에서 성적 소수자들이 마주하고 있는 위험의 실체는 바로 법과 사회 구조이기 때문이다. 대신 반대 팀은 성적 소수자들로 구성된 집단이 성적이고 범죄가 되는 행위를 저지르면서 그들의 본국에 해를 끼치고 있다는 점을 증명하려고 했으나, 찬성 팀은 반대 팀이 주장한 것과는 달리 특히 범죄의 경우 성적 소수자들의 집단이 사회를 위협할 만큼 크지 않다는 이야기를 하면서 이 부분을 적절하게 반박했다. 반대 팀은 사회가 성적 소수자들을 바라보는 시각 때문에 그들이 어떤 경우에도 보다 나은 조건을 제공하는 장소를 찾지 못할 것이라는 점을 증명하려고 했으나, 일단 앞의 주장과 마찬가지로 너무 과장되었다. 그리고 찬성 팀이 충분히 증명했듯이 이 세계에는 망명 신청자들의 안전과 삶을 보장할 만큼 법과 사람들의 의식이 갖춰진 국가와 지역이 존재한다. 결국, 망명 신청에 대한 최근의 관행에 대한 사안은 찬성 팀의 증거를 통해 효과적으로 다뤄진 셈이다. 재량권 시험은 이미 폐지되었고, 이 부분을 증명하기 위해 반대 팀이 제시한 논평은 성적 소수자들만을 대상으로 한 것이라기보다는 망명 신청에 관련된 전반적인 사항을 대상으로 했다.
