Opposition wins this debate. It seemed that the government team’s main arguments were based on the principle that if something is legal and harmful, other things that are illegal and harmful should also be legalized. I think the opposition pointed out the flaw with this when they called for the round to be determined on the societal costs overall. Government did not handle this argument very well, and some risk of serious harm still remains in my mind. Additionally, Opposition did a good job of establishing a reasonable explanation as to why and how governments should restrict individual choice. My decision is based on the overall analytical and argumentative quality of the opposition, who established their burden clearly and convincingly. Government’s principle of “legal equity” cannot stand against an argument based on risk where those risks are admitted to and proven to exist in the status quo. Government seemed behind on the “forbidden fruit argument,” not dealing with the Opposition’s arguments and just dismissing them out of hand. The issue of organized crime was mishandled on both sides, as the debate became about small technical matters and not the crucial issue of whether corporations perpetuate the same “crimes” through pushing products to people they might not need or might harm them. Government tried to do this late in the debate, and should have made the issue more about the harms to the individual and the need for governments to protect individuals as fundamental. The “forbidden fruit” argument works better in this frame. Instead of arguing “alcohol kills” the government can argue that “binge drinking kills” and then the Netherlands/U.S. drug statistics make more sense. “Binging” seems to be an action that individuals take when given access to the forbidden fruit take this away, they will establish a healthier relationship with the substance, and will be safer.

I would give this debate as a clear win for the Opposition. There were a number of deficiencies in the Proposition’s case which were successfully pointed out by Opp. First, the Proposition team seemed to be starting out by talking about the relative dangers of tobacco versus marijuana; only once challenged did the discussion broaden into one about all drugs, hard and soft. Indeed, a number of the Proposition arguments were quite ‘thin’, not fleshed out until challenged by the other side.

The “forbidden fruit” argument was also, I felt, never really proved; to say that it is truistic, and therefore doesn’t need to be proved, is not sufficient in the context of a debate where you are asserting that legalization of drugs will reduce the number of people being tempted to try them and the story of Adam and Eve, while it might be appropriate as an analogy or illustration of an argument, does not constitute “clear evidence”.

The arguments about individual freedom of choice, and legalization as a way to remove the black market, were more strongly made, and the latter in particular probably fell for the Prop team. However, the Proposition’s assertion that “drugs do not cause any harm to people who do not use drugs themselves” immediately struck me as extremely questionable, and indeed was very effectively countered by the other team.

Finally, the Prop side placed too much weight on the comparison between drugs which are legal in the status quo, such as tobacco and alcohol, and those which are illegal. It is perfectly valid to do this, and indeed there is an onus on the Opposition to explain why illegal drugs are so much worse than these damaging but legal substances. However, the Prop seemed at times to be relying on this imbalance much too strongly. The fact that some bad things are not prohibited by law does not, in itself, mean that other bad things should be legalized for the sake of consistency.

As for Opposition, I felt their rebuttal was very strong, using facts and statistics effectively, and questioning those which were raised by the Prop side some examples of this are cited above. More crucially, though, the level of analysis was generally higher on the Opposition side to mention just one example, asking *how much* this effect of the ‘forbidden fruit’ encourages people to try drugs, and if it outweighs the reduction in availability that criminalization entails. Finally, most Opposition arguments were expressed very clearly, and supported strongly, and for that reason I have voted for the Opposition side.
